In the last few days two rather large M&A announcements were made. But not for mergers of companies. Instead one company (Constellation Energy-CEG) announced an effort to buy a large power plant, and another (Duke Energy-DUK) announced its plan to sell a large fleet of power plants.

According to some reports, key memebers of Congress may actually have finally reached an agreement to repeal the Public Utility Holding Company Act (PUHCA) of 1935. If this actually holds this time, it would potentially open the door to aloow the freer flow of investment capital into the utility industry. This flow of capital could lead to other industries (energy) and other players who traditionally have not been free to invest in the utility industry to make acquistions of utilities.

The electric utility 1st quarter reporting season is essentially over. Historically, most electric utilities have the largest portion of their annual earnings (and the variability of annual earnings) in the summer months, which generally show up in 3rd quarter earnings, and have relatively quiet 1st and 2nd quarter earnings reports.
The reason? Electric utilities' regulated and uregulated POWER related businesses are heavily reliant on the increased demand (and sometimes premium pricing) that comes with the hot summer months.

Duke Energy and Cinergy announced today that they would merge. This is the 2nd announcement of what I would call "mega-mergers" within the electric utility industry in the last 6 months, after Exelon -(EXC) and Public Service Enterprise Group (PEG) announced in December 2004 their merger.
Investors should expect these types of mergers to continue to be announced as electric utilities continue to try to both increase their scale (and therefore increase their ability to use scale to reduce expenses per customer), and
